Threatening to sue the competition over their operational rules is about as stupid as it ing gets.

Threatening to do something and actually doing it are entirely different, just bringing an issue to the table, and posturing, hes not the 1 st and wont be the last

If you'd seen the season Petone Panthers had just had you'd think he'd got of lightly!

Still unfair, the club is unrecognisablecompared to 3/4 years ago, all because of 2 things, a structure that allows clubs to progress due to on field performance and somebody willing to invest under those circumstances

Many have suggested that Leigh would have been a ' shoe in ' for a licence, but that isnt true as the investement wouldnt have happened under that system

I'd like to make it clear that I don't like Leigh. I never have done. However, it cannot be denied that Beaumont has re-energised the club and the direction of travel is positive. For that he deserves some credit. I am not sure why some fans of opposition clubs get wound-up by some titbits he gave to the media.

I responded specifically and accurately to Jesus's comments....4k is not right as an average even with Bradford, regardless of if the style of play was nice your players were regularly the topic of the the disciplinary and the rules for salary cap and transfers as they are were agreed at the start...just because it didn't pan out for him is no defence for the dummy spitting of the Leigh collective!

As a whole I have little problem with Leigh or their charismatic owner who as you say, has revitalised the club. Unfortunately, his dummy spit combined with the small section of Leigh fans on-line who have claimed that the team would win everything have painted the club in a tarnished light over the last fortnight. Wins in the cup v average under performing sides and a close game against a Wire in decline resulted in countless threads on the VT and on those club boards where Leigh "fans" bragged and boasted of their rise from the ashes with a Grand Final appearance only a matter of a few years away......alas, its Ealing Trailfinders for another season at least.

As for spending to the cap in pursuit of promotion or to avoid relegation........isn't that what got us into the mess in the first place? Having money doesn't = staying up (London) or winning Grand Finals (Huddersfield/Wakefield)

Derek is playing them like a good un,so let's keep raising the bar Derek,all I know statto was a couple of years back we were bobin along on 300k a year which we usually lost to the tax man as we were always skint now we are pulling in over 4000 crowds unless I've imagined the last month or so please tottle off and check for me don't let facts get in your way,like I said record sponsorship for us more income through our BBC appearances tied into sponsorship deals and were still growing...... Halifax, Batley, Bradford whoever I don't particularly care who we start off playing next year the fact is if we perform well enough we are back playing SL clubs again in August 2016.

If an operational rules is illegal. Whether you signed up for it or not it cannot be enforced.

The bigger question about the SC is how much the rfl is willing to go into bat to protect a rule that doesn't actually effect or benefit them. This is a possibility illegal rule the RFL administer but don't actually get anything out of.

I would bet, like the quota, we never actually get to the courts and as soon as the lawyers get involved there will be an 'accomodation' made.

Its not. Any player can earn themselves up to anything they want in theory. However in practise it would mean that no other player playing for the same club can be paid. The RFL aren't restricting trade or what someone can earn, they are telling clubs how much they can spend on players.

It's a collusion between owners to restrict the earnings of players. It is by its very definition a restraint of trade. There is no argument it isn't. There may be an argument that it is a reasonable one. On the previous reasoning given by the RFL as to that I think that would be a difficult argument to make. The rfl and clubs may feel differently.

There is different arguments to be made as well. Derek Beaumont is unlikely to bring a restraint of trade case. He would more likely look at other avenues. It would more likely be a player who does so

You are going to have a hard time convincing anyone with even a tiny bit of a brain that a salary cap is not a a restriction on earnings.

I mean the entire reason for being of a salary cap is to cap salaries. That is literally all it does and all it sets out to do. It is nothing other than a cap on salaries.

It may be a bit pedantic but in theory a club can pay a player whatever he wants. Its up to the club how much they can afford.

Neither in theory nor practice is that true.

And even if it were true, it has the clear and demonstrable effect of lowering wages and would still need to be defensible.

Some may think that there are trade interest and public interest arguments that could be used to defend the SC. I think on the evidence of its actual effects those arguments would be difficult to make.

I don't think anyone. Even the rfl. Would defend the SC on the basis of a theoretical possibility of only 1 player being paid the entire wage, not least because that is still a cap. (And would also contravene other SL rules.)
