Mr Justice Saffman, in the Leeds High Court said
“I therefore have no difficulty in finding that the claimant has established, on balance, that this was a wrongful dismissal.”
So then awarded £167,000 to Mr Mason for loss of earnings and the court costs of £35,000 against the club.
The sting in the tail is that the terms of the of Damage Payment will be discussed at a further hearing.

Correct me if I'm wrong but from what I understand Giants were not found guilty of tapping up but having broken a gentleman's agreement not to poach Bradford's players. There appears to have been some kind of brokered compensation deal which amounted to £20k on the basis the RFL threatened not to register him.
With Koppy now saying he agreed on August 8th, this is clear evidence he was tapped up and begs a some interesting questions.
1, Was there a hearing?
2, What was the judgement?
3, What was the evidence given by Kopczak and the Giants?

According to the T&A article both Kopout and Thewlis agreed they had lied to the RL in regards to when he agreed to move there. What punishment can the RL dish out to Shudds? Surely a points deduction and a fine is in order.

In the real world the original charge would be filed, the compensation agreed would be set aside as based on false information and a further charge brought of bringing the game into disrepute.
As this is the RFL, they'll be unavailable for comment.

I'm not sure I agree with a points deduction for what is a business decision, but there must be some sanction for both Kopczak and the club for lying to the RFL.
From the Bull's POV, if the 20K compensation figure was based on the RFL accepting that Huddersfield hadn't made an illegal approach but was paid to as a kind of good will payment to smooth things over, then that should be looked at again in light of the court admissions.
If the 20K was paid in admission that the approach was illegal, and we accepted it, then I'm not sure where we have cause to complain.

It's not their fault that the clubs management made poor decisions and then lied to cover it up, but I'm sure they'll all be on here soon retracting their assertions that nothing wrong had happened...

An investigation was carried out and no charges were filed. There was no admission and Omar is stating this is because during the investigation Thewliss and Koppy denied to the RFL they approached Koppy before the deadline and have now stated on oath that in fact not only did they approach him, but they agreed a deal on August 8th.

Huddersfield board are claiming that the amount does count, but is split over the period remaining on the contract. Either way, it could have been a couple of new players for them... Shame
I would expect the RFL to be a little "concerned" that both Huddersfield and Kopout lied to them previously, doesn't show them in a particularly good light. |

£95,000 a year for Mason! 
So imagine what they must be paying their good players. And all under the cap. It's baffling. |

| I don't see any valid reason why the whole amount of payment for services to Kopout shouldn't count against their salary cap.
In the T&A OK is quoted as saying:
Quote “We feel vindicated in our stance at the time that Kopczak had illegally spoken to Huddersfield well before we took over the club on September 1.
“Both Kopczak and Giants’ managing director Richard Thewlis have admitted under oath that they agreed a contract on August 8, despite Kopczak’s contract with the Bulls still having 16 months left to run.
“We are also concerned that in October of last year both Kopczak and Thewlis denied this to RFL investigator John Dearden, and indeed Kopczak stated that he was not at that time employed by anyone.
“We trust the RFL will now further investigate this matter, which has seen us deprived of a player who was under contract to us when illegally approached.”

The RFL were "unavailable for comment last night". How they must be wishing this had all been swept away under the carpet after the 20K decision, but, simply, they HAVE to address this now. What about today, then? have they got up yet? |
