On the idea that Briscoe to Aus is a done deal - if it is, this seems an odd thing to tag onto the end of the Crooks story on the club website:

Gentle is assembling a strong squad at the Black and Whites with a notable balance of experience and youth with the likes of Crooks expected to be joined by further contract extensions in the near future.

On top of that, the likes of Danny Houghton, Joe Westerman and Tom Briscoe are three more experienced young England internationals that have already established themselves in the team, which has then been enhanced further by the arrival of new signings Liam Watts and Jay Pitts.

Complemented by the experience of captain Andy Lynch and new marquee recruit for 2013, Gareth Ellis, these players are the backbone of the club for years to come and the future certainly looks bright for Hull.

Quote: Airlie Street "Depends if their children are British citizens, the EU human rights bill has been used to successfully keep illegal immigrants and foreign criminals here based on their dependants, happens all the time.

Of course people have also been deported, but given the quality of the legal team he can afford, the minor nature of his conviction and his community contribution during his time in the UK I'd be amazed if Chase got deported.'"

Deportation will normally be proportionate where the foreign national criminal has received a custodial sentence of at least 12 months and less than four years, or has received a custodial sentence of less than 12 months and, in the view of the Secretary of State, their offending has caused serious harm or they are a persistent offender who shows a particular disregard for the law. Deportation will not be proportionate ifor in the UK with refugee leave or humanitarian protection), and they have lived here with valid leave continuously for at least the last 15 years (excluding any period of imprisonment) and there are insurmountable obstacles to family life with that partner continuing overseas; or
- they have a genuine and subsisting parental relationship with a British citizen child or a child who has lived in the UK for at least the last seven years, and it would be not be reasonable to expect the child to leave the UK with the foreign national criminal and there is no other family member who is able to care for the child in the UK; or
- they have been continuously resident in the UK for at least the last 20 years (excluding any period of imprisonment) and they have no social, cultural or family ties with their country of origin, or they are aged under 25 years and have spent at least half of their life residing continuously in the UK (excluding any period of imprisonment) and they have no social, cultural or family ties with their country of origin.

So you we're simply being pedantic for the sake of argument rather than actually contributing to a debate. You knew exactly what I was referring to although granted I used the wrong phrase.

I'm no expert, but IMO Chase doesn't fully satisfy any of those 3 situations, so it would still be the area in the middle where either outcome could happen.

No. I was correcting a common and misleading mistake which is often used to cloud arguments surrounding immigration as well as a number of other issues. There's also the fact that our own Human Rights legislation would be used initially before any appeal to the European court.

True but most cases that are ordered for deportation by our own Human Rights legislation get appealed and so ultimately the decision lies with the European court, it's just a case of going through the motions.

I spoke to an ex UKBA worker regarding Chase, he indicated the Government in the current climate
will try and deport people, but ultimately the Government would fail.

I am certain every UKBA worker knows the intimate detail of Chase's case, and would be happy to discuss them in detail with a random member of the public, honest.

No but he would have a better idea of the process, appeals and the overall current trend of outcomes than anyone posting on here, regardless of what you might like to think.

That may very well be the case, and I do think he'll eventually get a visa. I just didn't see him fitting the examples suggested to make it more straightforward. It could prove to be too protracted for it to be practical to pursue it.
