The only possibility of getting round this is that his conviction only carried a suspended sentence, and therefore he was never imprisoned. That is, however, clutching at straws considering he can be refused based on his conduct and character anyway and he has a serious conviction.
I'm also not sure if he will be able to prove his current relationship is long enough to meet criteria (particularly if they find he went on a bender after an argument with his missus!)

Nope, he has the right to enter the UK on his existing visa until the point that it is revoked by the HS. The problem is that he will struggle to get a NEW visa.

Unless I'm missing something, an unmarried partner only needs a 2 year relationship to qualify, as before. I hope we haven't applied on the basis of a shorter relationship, or applied for the indefinite visa without the partner visa being in place already

He has to qualify for entry every time he comes back here, so if the conviction was in place it would have to be considered. Im worried they've got him for non-disclosure of a material fact (320(7A)) for not mentioning it when he came back from Oz.

Why would cas give him a 4 year deal but not apply for a longer visa at the time?

Possible, but it's a bit of a pointless rule in a practical sense, as only the HS can retract a visa and unless she was at the airport at the time, it's highly unlikely.
However, he may have failed to mention that he had just been convicted when he arrived back in Britain after his visit to the Australian courts!
Whatever, his chances of a new visa are as slim as a slim stick-insect on a diet.
