Good stuff. No doubt it will have helped particularly with Piatt's stance, this after accepting SWAG's support and the goodwill of the fans and general wakefield public. I also expected an approval but I know councils can't often afford to defend the case when it's taken to appeal.
I guess yourself or Phil will know whether the 'good news' was linked to a positive judgement on this application?

I wonder if this is the same person that gave the Council the previous *in house* legal advice that the Council could not provide evidence of, when the stadium trust requested.

| Sorry guys, I still don't get it.
Surely a better result for us would have been approved subject to a new watertight s106 agreement??? Could the planning committee have done that? Or are Yorkcourt now saying that s106 agreements are not legally enforceable and therefore there would be no point?
I get that it is good news in that YC don't get to make more profit and not contribute anything, but it doesn't help WT in getting a stadium does it? Or am I missing something?

I don't get it either Fordy but I have come to this conclusion - Yorkcourt have absolutely no intention of providing a stadium and never did have. They cheated and deceived and are still doing it. Anything that hinders their progress at doing the same can only be applauded.
If I had the money I'd personally pay to fight their appeal . I sincerely hope they go bust somewhere along the line. Capitalist scum!

It's quite clear YC are nit going to stump up so it's either the council or the club through a council guaranteed loan, or nobody at all so no redevelopment.

Only from previous information, minimum cost for a.new build stadium, would be one million pounds per thousand spectators. Therefore a ten thousand capacity stadium would cost a minimum of ten million.

But the applicant made it clear that he does not have any legal obligation to make any contributions whatsoever to the stadium and the Council Officers agreed and recommended approval.
We argued that promises were made at a Public Inquiry that should be kept and the applicant should not be allowed to renage on these promises by trying to exploit what he sees as a possible loophole in the law and the Committee agreed with us.
One of the members summed Newmarket up perfectly as a complete mess. It is a mess and very complicated legally and it may need a High Court Judge to unravel the mess which the Trust would welcome.

The decision was “mindful to refuse”. The Councils Solicitor said there was no legal grounds to refuse and the applicant would win on appeal but the Members thankfully would not change their decision.
If it goes to appeal it goes to the Planning Inspectorate, the very people who the applicant promised to build a stadium so it would be interesting.
The Council will try to get members to vote it through on the back of the costs if they were to lose on appeal but we made the point if it’s approved we may legally challenge the decision.

| I believe the good news is that Colin Mackie (Yorkcourt) got a bloody nose today and although Box will no doubt offer him a handkerchief, he needs to have further investigations by the very body he promised he would build a stadium to all those years ago !!
