Yes mate, that's the one I was referring to (the trust mentioned on the Cas website). Similar to the Wakefield Wildcats Community Trust, as far as I can see. Both have direct links to the respective clubs and are therefore different to the Wakefield Community Trust.

But that is a community trust set up to deliver specific things to the community, exactly like Wakefield's, but the 'Stadium Trust' is a separate entity so I would think Cas either have something similar already, but not really mentioned it to date, or they need to set one up to access the funding to make everything legal and above board.

In answer to the question about partial use of the funding I think it may relate to this;

www.wakefieldexpress.co.uk:80/ne ... s_1_974313

So they havnt used any of the money just a guarantee against it.

Quote: Khlav Kalash "It was a loan from the HBOS I think, but as the WDCT has no tangible assists in which to borrow against, the council needed to guarantee the loan; perhaps the council then guaranteed this figure against the £2M value of the proposed land loan, but I am just speculating.'"

Just about spot on KK. The Community Trust needed WMDC to guarantee a loan to cover the planning costs (think it may have been from Co-op Bank rather than Bank of Scotland - but that bit doesn't really matter).

The £2m is the value of land being made available to both schemes to assist in gaining the necessary funding. Once planning has been granted the Community Trust will pay off the loan guaranteed by WMDC using the funding obtained for the stadium development.

If the planning is refused the council will have to pick up the tab for the loan for the planning costs.

Bottom line is that if NM doesn't get the go ahead, either by the Government saying no or Yorkcourt just going ahead with the industrial aspect, the taxpayers of WMDC pay 150,000 for the failure.

As i understand it, such a trust would take about a mornings work to set up (if we dont have one already) so it shouldnt be any sort of a problem.

Setting up a trust much like setting up a company takes about a morning to do - contact any accountant and they can craete a trust from a standard set of documents with a change of name and a slightly altered memorandium of association and articles.

That link you have above is not a requirement of a trust - that has been done to add "meat to the bones".

How much did the taxpayers waste on that bridge and all the rest of the crap they did at cas, and then on the new wakey Market and the Hepworth museum, how much do we waste on boxys executive transport and chauffer, how much we waste on councillors expenses and tea coffee and biscuits at meetings????
The fact of the matter is of we all knew what was wasted we'd be horified, it's small potatoes, don't sweat over it.

Perhaps it has, but it still makes the trust slightly more credible than something that you and your accountant could knock out in a morning. That's quite important, I would have thought, when it comes to lending out 2 million quids worth of public assets. And it still doesn't resolve the question of whether setting up a trust in this way is merely funding a private company through the back door, so to speak...

Hatfield is correct. You can set up a Trust/limited company in 4/5 hours.
If a trust to run the Cas Stadium has not been set up already it is not a problem.

With regard to your last statement (which may be an attempt at mischief - sorry if I am wrong), I am sure you know that The Wakefield and District Community Trust is a Private Limited Company

No bigalf, I'm not aware that Wakefield and District Community Trust is a private limited company. I didn't even know that a trust [icould be[/i a private limited company. But I don't claim to be an expert in any of this, I'm merely asking questions to try and understand how the whole thing works. Show me where you have this info about the Wakefield and District Community Trust and I'll happily believe you.

Why do you assume this is mischief-making? It was alluded to on the WTW website, so it seems reasonable to me to pursue the question on this forum. Would you not agree?

God bless casforum (for once). Take it from about here

Seems that in the hair splitting lies the answer. Still, thanks for the pointer.
