Surely the commercial rent for a brand new stadium would be more than Belle Vue? If you move from a one bed flat to a four bedroom detached house you'd expect to pay more rent?'"
But weren't the statutory duties not enforcable until after the trigger point which has never been reached? They could have done more yes but that is a different argument rather than statutory requirements. The land is still mostly undeveloped.
And yes you would THINK the rent would be more but unless you KNOW that to be the case then you can't claim it to be so.
A legal line has now been drawn, statements need to be tight as a drum to avoid slip ups. There is too much at stake for them not to be.

I hope the genuine threat of action is what finally leads to something getting built without ever getting as far as the courtroom. Usually in these cases it does to save face, hassle and money. I believe it is the most likely outcome from here and the only one that will actually mean a stadium gets built before we get the push from superleague.

Who was responsible for ensuring the s106 was fit for purpose?
Who accepted the unilateral undertaking?
This may be where the council messed up. With the SoS being involved they seemed to feel they were relieved of their duties. Maybe they sleepwalked into this deal and honestly felt it was nothing to do with them.
It seems like the legal case may be based on the LPA's failure to ensure community benefit from the planning gain.

Let's also not forget what they have done re the Cas s106 and the benefit to a private entity that deal offers whilst at the same time saying the Newmarket s106 was nothing to do with them until recently when national media exposure forced them to make it look like they were trying to do something.
There is also the "missing" legal advice around allowing newcold not to count towards the trigger point

Forgive me for getting the impression that whatever the club does you always seem to want to have a little dig and search for a little bit of fault. I may be totally wrong and will give you the benefit of the doubt. Therefore....
Can you tell me what possible reason the the council could give in order to justify all the Newcold development not being part of the trigger area.
Bearing in mind they have admitted in writing to Mary Creagh that this agreement was reached between, Roney,Wallhead and WALKER. IN a closed room with no minutes and have also failed to give any reasons for their actions.
Do you also accept it is extremely reasonable to suspect that if a further development is planned then the council will adapt the same policy. Their past actions alone would suggest they have clearly demonstrated they have no intention for a stadium to be built on Newmarket.
Regarding the rent I am led to believe that the club have asked for specific details. The architects of the Belle Vue scheme have failed to answer and I am sure they have not concocted a figure themselves. How can you deal in such a shoddy way with a financial situation such as that. If all you get in varying ball park figures how can the club be nailed down to the specific details.

I think everyone is aware that they (York C, council etc.) had no intention of ever reaching the "trigger point" while ever a club by the name of Wakefield Trinity are in existence in the top flight. hence I presume, little need to mention that particular red herring.

Don't need to pretend.
No in all seriousness you’re right, i'll step back from the forum, i realise having views that might not necessarily 100% fit with with the status quo and is scorned upon and a united front needs to be seen right now. Lets hope the club come through the other side with potentialy the biggest and most important win of its history. Good luck to all involved. Go get 'em!
