Their argument is obviously on a legal technicality, but the rules as far as I am aware merely state an administration event leads to sanctions including loss of competition points. There is also a clear precedent that this starts at the equivalent of 3 wins and can be reduced if creditors are paid off.
Consequently, how they arrived in administration appears to have no relevance under the rules.
Finally, I would imagine that the money they have spent on the initial appeal and any subsequent high court challenge could have been better used to pay off some creditors and get points back.
