| Trying to get my head round all this, the club are taking legal advice?
Against whom? The council? Peter Box?
What are we hoping to achieve?
Are Yorkcourt going to be a part of the process?
Has the "unofficial" trust been registered yet?
Does anyone, including the council know who is to be involved?

| The advice they appear to be taking is regards taking the WMDC to the High Court rehgrding the Council's alleged "Dereliction of Duties" against Trinity and the citizens of Wakefield.

Council - Dereliction of there Duty to enforce the 106 agreement whilst by-passing the Trust and raising the trigger point would be my guess.
No point suing Yorkcourt they will just go bust and reappear as something else. No it's WMDC as the governing body that is vulnerable. Lots of cases of local authorities being successfully sued for all sorts of things.
Now whether it will be a success or not I don't know. How strong the case is nobody on here knows, only the Club and more importantly the Trust know that and they for obvious reasons aren't saying. You have to assume that as intelligent people they know they have a case which the Lawyers will hopefully confirm.
Forget about the unofficial Trust, if that were ever going to appear it would have done by now. Now we have started proceedings any 'new' trust would have no legal validity at all. Our Trust is the only Trust and was legally recognised as such during he 106 enquiry - it's a red herring IMHO.

| There was the infamous "Donnygate" a few years ago. What we need is a "Wakey" gate exposing all the guilty parties if any decision goes against WMDC.

It's hard to believe that Peter Box and his stooges Mackey and Walker and co have not made a lot of enemies through the years.
I assume the lawyers will do this but if anyone knows any dirty secrets or of someone who might please let the Trust know.
Even if they can't supply any ammo they may wish to chip into the fund in the hope of seeing these toads get a black eye.

I think you're right - and that boring link I posted last week was quite a comprehensive essay on LA's and their legal obligation around S106 agreements; and it referred to quite a few examples of case law where authorities have failed in that regard, and been sued.
I can't see YC being the subject of any legal case - but they'll certainly be named and hopefully embarrassed; same goes for Rodney Walker, who won't enjoy being portrayed as a bad actor, which he most certainly has been.

| I think Peter Box is immune to criticism. Having been in that post for so long. By now his ears should be mere charcoal stubs after all the remarks that I've heared about him and that woman sidekick, Jeffries. The one that I think would be most embarrassed is RMW. He likes to come across as a man of the people and I was at the SoS hearing when he stood in the witness box and boldly claimed that," He was instrumental in Delivering the new Webmbley Stadium" (or words to that effect). He must feel something of an idiot when he couldn't even deliver a modest community stadium in Yorkshire.

| My though on it is that if the club have a strong case, the lawyers will confirm this, then the council will start to worry. Worry them enough with the prospect of having to defend themselves in court where little secrets may become exposed to the public, and they will quickly throw the developer under the bus in the hope of saving themselves before it makes it to court. What happens then is anyone's guess. My take is that best case we can hope for is that the council will loan the trust the money to build a stadium which the interest will need to be paid on, and the council will force the newmarket developer to actually promote and develop the site so the council can recoup the costs

Yeah I had a read through that & it made for a fairly interesting read tbh. The point you make about LA's not meeting their legal obligations around a S106 & ended up being sued, is obviously going to be the thing that makes or breaks the case where we're concerned. It's a long time since I did my A level Law but as I remember it, as long as a solicitor when he investigates what's been going on in the past 7 years or so, can find legal precedents that have enough similarities to ours, they should advise us to take it forward.
Hopefully if this is all positive and we are advised to move forward on this , like Egg Banjo says, it then gives WMDC the kick up the backside & they pull their finger out to use the power they have. To somehow move this Community Stadium/facillities and warehousing forward.
Like I mentioned on another thread, when you read all the documents that WMDC put forward on the planning portal about the development at Newmarket & all the great things it was going to do for the City. Not only in a sporting sense (at last we were finally going to get a Community sporting village of sorts, that had been talked about for years) but also in a job creation sense (where it was going to create around 2000 jobs) and at virtually no cost to the LA.
I also remember something about Leeds MDC wanting to do a development on the other side of the M62. It all just made you think what a prime development location it is in & it is. Yet we sit here coming towards the end of 2017 & nothing has been built towrds the trigger point of the Community facilities & only 125 jobs or so have been created. Surely even if you had nothing to do with Trinity or RL, it's an unvelieveable story & crazy it hasn't all happened.

| I would not have thought that any legal action would be taken by the Club who were only ever going to be anchor tenants at the Community facilities at Newmarket . I would presume that an legal action would be taken by the Trust.

MC said that he'd finance a legal challenge that's why I assumed it was the club and not the trust.
