The club have no cards to play in this and are at the total mercy of a developer who has failed to deliver what he promised time after time and so far not one penny has come from his pocket.
Then factor in a council who seem perfectly happy to allow this , I think you may hear some good sound bites and press statements but it could be an extremely long time before anything substantial happens. Lets not forget the stadium is only a loan every penny has to be repaid if Yorkcourt fail to pay up.

Having read the Wakefield Express article, I now feel there is a hint of skullduggery within Council chambers. I am aware there is now less than a week before the planning meeting, but I do hope we have some advice from the stadium trust by early next week. I know TRB is no longer a trust member, but it is known that he will oppose all planning applications for Newmarket Lane, until the developers provide funding for the community stadium project. I, and many others will support him, and continue the objections, but we need advice from the stadium trust.

Having had chance now to read the summary in full i must admit he makes a compelling case for the decision to be overturned. But previous council commitee decisions do carry a lot of weight and who is to say that there isn't another Mr Swift in the new lot who will plead the case well. It may be though that you are correct and they go with the 'legal advice' but time will only tell there. But i really don't think it is the foregone conclusion you think it is thanks to the previous decision, although i'm nowhere near as confident as i was yesterday before i knew it wasn't just the box ticking exercise. One thing for sure though is that Yorkcourt will be better prepared this time and will give it a much bigger push, last time i felt they thought in was a shoe-in and were complacent.
To be honest it is all pretty immaterial anyway, the only argument is how rich Yorkcourt & Co get because whatever the result there is no way in this world they are funding a community stadium.

They were never going to contribute, if people hadn't already worked that out previously the last application once and for all confirmed that. It's why the club/trust have taken back some control by getting BV back and looking for funding streams themselves.

| Its not YorkCourt that you can take legal proceedings against, they have not done anything wrong, they are only doing what the Council has, is allowing them to do. This situation has been set up by the Council so if you wanted to go legal you would need to instigate a judicial review, to review how the council have handled things from day one, it could take at least a year and you would need a minimum of £ 300,000 to fund it. Not sure where that would come from, people have talked about crowd funding, think that may achieve say £ 10,000

You can’t instigate a judicial review over how the council have handled things since day one as judicial reviews are time constrained and that horse as long since bolted.

I agree Yorkcourt have no intention of paying a penny and they never will whilst ever our council help them in every way they can. What frustrates me is why we are even keeping up this pretence of them doing so. If our council were half decent they would be looking at any future schemes on the horizon in order to fund a community stadium.
However if we stick to the idea that Yorkcourt will provide funding we will come to a stage in a few years when every bit of Newmarket has been developed and nothing has been forth coming. By then we will be playing out of a total wreck of a stadium with no chance of up grading it and a 3.2 million debt with rolled up interest that will need repaying. We will have fannied around for well over twenty years and be back to the same state we were in when the club was in previous ownership

If our council were half decent this wouldn't be happening in the first place. Even if we put the original Newcold application and it's circumventing of the stadium trigger points down to mistake or undersight, they still seem intent on moving the goal posts to get this latest application passed "

| Just reading the WE article regarding planning for Newmarket, apparently the council have asked Yorkcourt to contribute to the upgrade of BV, Yorkcourt have declined suggesting that it wouldn't be "lawful" for them to help fund the stadium. Is there anyone on here involved in planning that could explain why it wouldn't be lawful?

Some time ago, Carter said he’d fund the court action himself so it’s not a problem
I’m not sure how cosy he’s got with Box since then, as the loan deal suggests they’ve forged some kind of relationship.
