| Sorry guys can't seem to get a link set up.
A letter has arrived on the planning portal from Gatley the solicitors of Yorkcourt in respect of their recent planning application. In summary they are stating they have no legal obligation to provide any 106 contributions whatsovever regarding their development at Newmarket.
At least they have made their intensions clear and we mow know its time to get the gloves off properly.
It will also be interesting to see the response of Box, will he side with this greedy developer or will he do what is right. He now has to take sides and can no longer hide and evade his responsibilities.

| Not exactly surprising news. They were never going to roll over and say, 'oh go on then, have some some money', they were always going to resist. It's up to the council now to look at the legalties and decide whether turn down the application. Whichever side they fall on they will likely be going to court though, either by us if it passes or by Yorkcourt if it is rejected. It will get messy and very expensive.
One things for sure, this latest submission has confirmed they will never pay out for a stadium whether they were successful in court or not. They will either get their way and not pay out or just leave the land undeveloped.

| Yorkcourt just confirmed how bent and conniving they are then atleast. Lets see what our local planning authority is going to do about it, surely they're not going to let them profit further after deceiving the 1000's of citizens who voted for the land to be taken out of greenbelt...

I know what my money is on. Remember this council held a public enquiry and also paid for the services of a barrister to help get Yorkcourt their planning in the first place. (A F.O.I. request asking for the cost was turned down) However estimates are that it could have cost the rate payers of Wakefield £300K to assist Yorkcourt.
Then we had the secret meeting with the council and that ..........! Walker where yet again this council assisted Yorkcourt to circumvent their obligations regarding Newmarket. (all un minuted and no records kept of details or reason)
Box will just say we have no power and it can go ahead.

| So because Yorkcourt are refusing to give a penny towards a Community Stadium But are now trying to get as much developed has they can from the Land the Council change from green to brown field So Can't the council some how revoke the land from them for not filling out the obligation of the 106 agreement and change it back to brown field so they can't developed on it any more, Because i just don't get it how a business can keep what has been given to them(the land) and give feck all back.
Where do we go now with this shambles should we start a trust fund for all People/Business anybody to donate into this to do the right thing Court

| I should think this comes as no surprise to MC, IA, SC,TRB, etc or for that fact Councilor Box . Yorkcourt have not done anything wrong our council has allowed them free reign to do as they wish . Our fight is with the Council, I would be surprised if Manni has not been sent with messages of the threat of eviction if the Legal threat is not withdrawn. I eagerly await the planning meeting being reported on , we will know then exactly where we stand then.

| The planning process will be a public event. It will be in the Council Chamber at County Hall. I will try and attend and I hope many others do. We will also see which way individual councillors vote. Also prior to the vote evidence etc will be presented but best of all the planning officer will summarise the application and advise the councillors which way they should vote.

Pretty forthright in their attitude. The council have really back themselves into a corner with this. They won't have any fight to defend themselves in a legal case nor any money to either.

| Can someone with knowledge of the original deal and know how on the planning etc explain just how Yorkcourt can absolve themselves of any responsibility towards the community stadium and it it the responsibility of WMDC to enforce the agreement.
Is there any precedent for 106 agreements being breached in this way or do we really have an utterly inept local authority.
Is it 7 years to get to this point ?
