What puzzles me is that 106 agreement was given by the vendor of York court to provide a ground etc to wakey T, & not to the council coffers for them to generally fill their coffers & distribute as owners of that money, yes legally they operate the 106 etc.
Further more, lot all the other 106 agreements for all specified things like roads, buildings & any other property, does that mean they monitor their money to those schemes & own them & control their value & use as they see fit, at what stage does control & ownership cease ?'"
Their job is to ensure the money collected from developers is used for the purpose it was intended, in this case funding for new facilities. It is not their money or investment.
The real story is why so much of these S106 payments has not been allocated for the purpose it was asked for?!
