The Council has an obligation to, within seven days of receipt of the draft Delivery Plan from the Club to notify the Developer of its receipt and to provide a copy to the Developer which copy may be redacted in respect of information which is confidential to the Club and/or the Contractor. Within seven days of the approval of the Delivery Plan to notify the Developer in writing that the Delivery Plan has been approved by the Council and to request payment of the Belle Vue Contribution. On receipt of the Belle Vue Contribution to pay it into a designated bank account to be used solely for the purpose of funding the Belle Vue Development. To use the Belle Vue Contribution solely for the purpose of contributing to the cost of the Belle Vue Development.
Spirit of 1873 submitted their Delivery Plan for the stadium improvement works to the Council for approval on 01 June 2022, for the purpose of fulfilling their obligation under paragraph 1.2 of Schedule 2 of the S106 Agreement.
