| Wouldn't it just have been easier to ask the council the question "will this affect the s.106 agreement?" when first alerted that the Newcold development was not in accordance with the original design?

Isn't hindsight a wonderful thing.
In any event why would anyone think to ask that question when the Secretary of State in his report and consent stated that the development could not be disaggregated which the Council appear to have done.

| Quote Sandal Cat="Sandal Cat"That's why we have Courts, to settle differences and rule on ambiguities.
If it is decided that legal action is the only way forward we have to decide whether to take action (and raise the money to do so) or give in and probably let the Club die because there is no way we can continue to play at Belle Vue at a cost of £250,000 pa.'"
So how long can we afford to play at Belle Vue and is there an end target date before you make the decision? And if we were to get relegated, which is a distinct possibility, how would this affect things?

Sir Rodney is a diplomat and very good at it.
He is Chair of the Stadium Trust and I hope he remains as such.
Quite happy for now for him to remain in the background.

| Terrible article. Really forgettable. They haven't drilled into any detail nor hammered the real villains in this saga at all. All it looks like is Trinity whining that they haven't been given public money to contribute towards a stadium.

| Sorry to appear negative but I have the same concern as "The boyem" basically YC never had any intention of building a stadium, they used it as a mechanism to secure the planning permission and they will develop up to the trigger point and then walk away with a tidy profit and a big 2 fingers to the Stadium Trust and people of Wakefield.
In that scenario nothing else that has been talked about matters, because they will have no obligation to build the stadium and therefore nothing for us to challenge through the courts or otherwise.
If we cannot afford to continue to play at Belle Vue, unless a sugar daddy suddenly pops up from nowhere, I can only see one of two options in the next few years:
(1) We end up in the championship ground sharing with Dewsbury or Featherstone (assuming they would have us);
(2) We cease to exist.
Its an extremely pessimistic outlook, but IMO its the harsh reality.

| And when we cease to exist, the need for YC to build a stadium is gone and the covenant on BV goes too, then BoI will make a killing on selling the land to a developer.

That looks suspiciously like the write up in the Wakey express.

There is no covenant on Belle Vue, that's a myth, I've looked at the Title and there is no covenant.
There is a condition (Condition 38) on the current consent to develop housing on Belle Vue that states no development can take place until the stadium at Newmarket is complete. Belle Vue's owners applied to have this condition amended but the Supporters Trust and Sport England objected and it remains but there is nothing to stop further applications and we may not be as successful next time.

I think that's a question for Michael Carter but he has already said that with such operating costs the club is unsustainable. Just think what you could do with the substantail saving of a reduced rent to the playing staff.
Heaven forbid we were to be relegated. Could the club survive with lower income and gates and still pay the £250,000 running costs.
