| has a testimonial been arranged for him? that would raise some money for him or a charity, brain trauma foundation or something like that. Any other player retiring injured might do this but somehow I get the feeling this isn't going to happen. I hope I am wrong (again)

I'm not sure it would ever get that far anyway. Think for a second the precedent it would set. The lawyers would be the only winners & both codes plus wendyball would be sanitised to the point of a chess game (or draughts if you prefer).
And how far back would you go? Keane on that Norwegian lad? Or just three years as per statute? Minefield.

The precedent is already set. Haarland did indeed start legal action but couldn't prove it was solely keane's tackle that ultimately ended his career. However, Manchester United player Ben collet successfully sued both Gary Smith and Middlesbrough for a tackle that ended his career and was awarded over £4m.

It wouldn't be the first time in rugby either. Jarrod McCracken successfully sued Melbourne a few years back after a spear tackle by Stephen Kearney and Marcus Bai ended his career.

However, given the coverage it garnered and the fact that it went way beyond what even the most blood thirsty fan would consider acceptable, don't be surprised. Punching someone that has already been punched unconscious would not look good to a court, the only thing that would save it would be proving that the issues are being caused by that specific hit.

Every other post you make mentions Wigan, even when the thing being discussed has nothing to do with them. Your own board finds you embarrassing. That's not my opinion by the way. That's directly from members of your own forum.
I'm glad you're so consumed with hatred for all things Wigan. At least it blinds you to how sad and pathetic you come across. If you ever saw yourself as others see you I genuinely think you'd die a little inside.
However, the really sad part is that you seem reasonably intelligent. Somewhere under all the bluster and hatred there could even be a worthwhile poster. Forgive me, though, if I don't hold my breath waiting for him to show up. It could be a long wait.

In a civil court you don't have to prove anything, only show that something occurred on the balance of probabilities.

I'm not sure how the legal system works in these matters but does the fact that Hohaia submitted an early GUILTY plea to an offence (and received a ban for it) prior to the retaliation from Flower not come into play here.

Also the RFL summery on the Flower suspension states that Hohaia had not suffered serious injury from Flower's actions.
This season so far he has made 8 appearances for St Helens, made 196 tackles, 64 carries with 35 from dummy half.
I sincerely hope Hohaia is fine and his health going forward is not effected but any legal action against Ben Flower does appear to be legal minefield.
