No, actually. Leigh would be able to report Leeds (or anyone else) for poaching and the offending team would be punished as per the rules set out by the section you posted (which may or may not include financial compensation, I suppose it depends on the particulars of the case) BUT the fee would still be disputed and set out as I posted (I haven't worked out precisely how much it would be because I don't know the particulars).
Of course, that doesn't stop a settlement through the courts ala Harris, leeds vs Bradford etc.
