What he is proposing doesn't cover any of the above. It's effectively a public policy exemption to increase participation/to facilitate international competition. i.e. you can have an age limit if you're a gymnast or you can say "an 80 year old can't compete in the 100 metres".
He's talking about a policy whereby Warrington would decide "we're not giving anyone a contract if they are 31 or above". That is unlawful.
However, that is a good spot. Quite why Rubber Duckie didn't engage in a similar manner is lost on me. Actually, no its not.
On reflection, I probably shouldn't have called him a tit. I apologize for that.

Very interesting, admittedly most of my knowledge on the equality act comes from dealing with acting and theatre production - theres a lot more flexibility in those exceptions and wrongly assumed that was the same 
I suppose if I had enough time and research I could start to build a case on the principle (a) of your quoted section by providing evidence that a competitor aged x and up are at a higher risk at injury which in turn would lead to a player aged x is less able to fulfil his role within rugby league ... but thats going down a road that just wouldnt be worth the energy of a forum! |

I may well be grasping the wrong end of the stick, but I would have thought that there would be no problem at all with a Club having a policy of not signing anyone over the age of 31.
