Not that I am saying it is the case here but it annoys me when drivers think they are above the rules of the road. I was listening on the radio the other day to a Woman in her 80s who had got away with being caught speeding 4 times (I think it was) by the same camera she managed to keep her licence because she "relied on her car to look after her older sisters" both of whom it appears are in nursing homes. As far as I am concerned she should have lost her licence like anyone else would have, since when is it ok for some people to speed but not others?

Magistrates can elect not to enforce a driving bad if exceptional circumstances can be shown. These typically involve the consequences of proven hardship to 3rd parties if a ban was imposed.

Which is wrong imo, especially when in the case mentioned where exactly is the hardship to the 3rd party?
I am sure most people could come up with a sob story as to why they should keep there licence but I don't see why anyone should get the rules bent for them. Speeding is just as dangerous no matter what your circumstances are.

Perhaps they made a strong case that the care of the elderly sisters would have suffered as a consequence?
I understand your point, but it isn't bending the rules, it's applying the law, and the law allows for discretion. It is fairly uncommon to avoid a ban in this way.
I agree about speeding being dangerous regardless of circumstances.

| If im read the new drivers act correctly it is not a ban ,her driving licence is revoked and all she has to do is re-apply for a provisional and start the process again i.e. theory and driving test again.

Without knowing the facts of the case and judging them on their merits it is impossible to say.
I know a business partner of mine avoided a ban (crown court appeal) as I gave evidence of how his ban would result in real hardship to me as a small business owner and as a consequence, my family.

| I see that the stretch of road from what was the Audi garage near the college on Winwick Road to the island just before Birchwood expressway is now 20mph over its full length!!!!!!
I am thinking of setting up a business with men carrying red flags to walk in front of cars to keep their speed down and announce their presence to others.
Do you think it will catch on??

| I got caught 3 times in one day on the A556 at Northwich. Signs clearly show 50mph, but no mention of it being 40 for HGV'S! (which i was driving)
Anyway i sent in covering(creeping) letter along with my licence to DVLA explaining the situation and to my surprise my licence come back with only 3 points on it and a fine.

I have a friend who got caught on that camera recently (36 in a 30)...She had (and took) the option of a Speed Awareness course, which meant she managed to avoid the points on her licence, though the cost of the course is similar to the fine.
I doubt though that your friend will get such an option having committed the crime 3 times....

Yes, the most bizarre piece of speed management I have ever seen, considering you can still do 30mph down Alder Lane (arguably more in need of a speed reduction than Long Lane) which can be used as a detour for the same journey...
