I have never tried to excuse the assault.The judgement in these matters is down to the legal/justice system.

I saw it at the time &thought it certainly was an elbow in the face as did the touch judge who was standing right next to the pair of them.

Now whether it was "deliberate" or just clumsy, poor technique, an attempt to fend off that went wrong - who can say?
