Probably correct that there's no real need to take sides however we are now in a situation where the whole atmosphere around the club is back on a downer 2 days before our biggest game of the season to the extent of many people now apparently deciding not to attend the game. A situation that could've been avoided over a contract breach that allegedly happened months ago, featuring a player that if we go down will get his move anyway as a free agent, and if not would've almost certainly been sold to the highest bidder after the end of the season.

| Thanks for that. It's was never this hard to be a RL fan before Super league. Our teams will never get near the teams who have quality that have come through the ranks and be able to hold onto them. You can't just buy that. Sad for Salford and I don't know where this will all end.

Bang on. SRD promised him a certain number of man-of-the-match payments. All documented of course. Same as Chase, Dobson and a couple of others. How can you get these payments though when you cannot get selected in the team ? You can't get selected in the team because you want out. Call it a loop-hope in the contract. I'm sure the tribunal will get to the bottom of it.

| All I can say is, what a massive shame that it has come to this. Whilst Theo' representatives haven't cited money issues in their case for resignation, unfortunately they could have done if they wanted to. However there are other pressing breaches which they obviously feel gives them a pretty robust case.
I did put on here a couple of weeks ago that Theo categorically would NOT sign another contract with Salford, at that time I didn't expect this to be the outcome.
In all of this, lets forget Theo season has been cut short early, he wont be paid a penny more by the club and cant sign for another club until the conclusion of a tribunal. I doubt very much that this is the end to his Salford career that a lad who has grown from a boy to a man (with the help of some fantastically dedication Salford fans) whilst being at the club wanted. This was the very last option available to him.
Theo should have been the future of this club, instead they went and signed a 30 year old Michael Dobson on a 4-year-contract. Whilst I agreed with the Dobson signing and thought for 2 years, he could provide an excellent mentor for Theo, particularly to help bring on his kicking game (arguably his poorest attribute holding him back from being a top SL scrum-half) but 4 years was taking the p*ss. It meant Theo wouldn't get the starting 7 shirt until 2019 at the earliest. I can appreciate and understand his upset. He also hadn't been offered a contract extension since March this season.
Do I blame Koukash? I am not sure. He can only go off the advice his coaching staff gave him and they clearly said sign Dobson. Both he and Chase earn in excess of £170k per year, so how can you then justify offering your other half (regardless of his potential) a pay rise when the chances of him playing are extremely limited. Koukash must take the blame for the contract breaches though and the sooner he realises you cant treat RL players as he has done, the better.
Timing of the press release isn't ideal for the fans, but the players and coaches have known about this for the last 2 weeks and it wont change anything "on the eve of our biggest game of the season".

| The thing is, when push comes to shove contracts for professional sportspeople have to follow the same law as all (ok, most) other areas of employment.
Firstly, there has to be a reasonable resignation period. Even if an employee has a five year contract, it will stipluate the length of notice the employee has to give to terminate the contract. You simply cannot enforce a contract to it's end date, there legally has to be a period in which the employee can give notice to leave and then do so.
Secondly, Fages is claiming that the club were the first to breach their obligations under his contract, allowing him to leave immediately. Legally, it seems he is claiming constructive dismissal as the breach of contract on the club's part led to him being legally able to end the contract. This alleged breach could be monetary, but often constructive dismissal cases are brought under the "breach of mutual trust and confidence" argument, which could be open to many different interpretations and be for many different reasons. Usually, it's hard to defend or prove this as it is very subjectively based around the perspective of the employee. I would imagine the possible outcomes will be :
1. Fages takes the club to an Employment Tribunal for constructive dismissal. If he wins, the club will likely have to pay his loss of earnings between the end of his contract and his next employment.
2. The club will take Fages to court for Breach of Contract. This is extremely unlikely as even if the club win they will have to prove that they have suffered a direct financial loss to gain any kind of financial award, which would be very difficult in terms of a sporting organisation.
3. The club and Fages will come to some kind of settlement agreement. This is by far the best option for the employer and usually for the employee. This is what I would expect to happen.

| I'm not sure I'd miss Theo to be honest. I've always been a bit underwhelmed with him and never understood the hype. This whole tribunal thing is just the final nail for him, I'd be happy if he didn't come back to Salford.
