Some very confusing (or confused)language in that article. A CCJ is not "served", a judgement is, by definition, passed down by a judge.
A summons, however, is served but it is by no means a guarantee that judgement will be made for the plaintiff. There is also mention that the club may contest this "CCJ" but again a judgement is final and cannot be contested. All of which leads me to believe that Kooga have simply summoned the club to a court hearing.
This in itself is not an indication of an inability to pay, many invoices are disputed for many reasons at which time the creditor may decide to instigate court proceedings. Indeed I myself am likely to instigate proceedings against a company shortly, the communications between us have been amicable but ultimately I believe they owe me money, they disagree with me!
I suspect that the Salford Star are well aware of all the points I've made but it suits their agenda better to make it look like judgement has already been passed.

It would be nice to know the facts on this. I'm already seeing websites, forums and tweets going on about how the club has a CCJ against them on the back of this story - when we don't even know if any judgement has actually been made. |
