" I can confirm that there was no Section 106 Agreement to link this development with the funding of a community stadium as the size of development (22,300sqm) is below the 60,000sqm threshold for contributing toward the stadium that was set out in the original outline application issued by the Secretary of State. "
I was under the impression that the 60,000sqm was the trigger point, I didn't realise that only units above 60,000sqm counted towards the stadium .

Because it doesn't, if YCP built a 1m X 1m box and leased it out then it would count towards the 60,000m2 trigger.
The Council officers reply is misleading either because they're too incompetant to understand the S106 or they're intentionally lying.
There is a ruling in the Secretary of States Public Inquiry report which specifically disallows the aggregation of the land in question.
The WMDC have incorrectly allowed the Newcold planning application to be passed directly contravening the Secretary of States order. Why they've done this is up for conjecture, either they're incompetant or they knowingly shafted the Community and the Stadium Trust.
It stinks and they're now wriggling and spinning trying to get themselves off the hook

If that is the case then produce some minutes or documentation to prove this. Do you honestly think if people had been aware of this they would not have kicked up a stink. Also how were the local public, you know the residents and Wakefield inhabitants informed of this decision to exclude from the S106? Do they not matter too?

We are not asking the council for a stadium, just for them to enforce their own planning regulations on a developer who is trying to wriggle out of their responsibilities and agreements.

No they didn't. First home game was against Salford at BV. First Sky home game was at Oakwell. Jog on fella.
