Think the main point of this thread is that it was sorted. Then the developer back-tracked and Wakefield MDC conveniently looked the other way.

Quite right and someone within WTW didn't read the small print.

The delivery of the S106 is the responsibility of WMDC led by Mr Box (you may be familiar with him). He represents the people of Wakefield and he is failing in his duty. Why are the facilities promised to the people of Wakefield failing to materialise, but the area is being developed?

Because the all-powerful Wakefield Trinity R.L.F.C, failed to read the small print apparently .
If they had noticed the scurrilous actions of the developer they could have informed the Council who would have immediately intervened & saved the day, wouldn’t they?

Er, no.
I think that is the point, the plans for Newcold were put through, without the club being informed and more importantly, without any chance for local residents to object to a building that is a mere 42 metres tall (24 metres higher than anything that was planned originally).
Trinity have requested details of when they were informed and how the information was given to them but, as yet, this has not been forthcoming, draw your own conclusions.

| Have to say some of the gleeful, gloating sentiment coming from some on here is depressing. Very real possibility of one of the founding members of Rugby League going down the pan due to the stadium issues (and several decade of poor management)
Wakefield as a city left without a professional sports team of any kind with some of the worst sporting provisions in the UK.
Nothing to be gleeful about IMO.

Correct - a 17m high unit would have made a significant contribution to the community facilities being developed. However, a 42m high unit, visible from space, was allowed to not contribute by keeping it quiet until it was too late to object.

" A meeting with the Trust Chair (Sir Rodney), myself and Andy Wallhead ( Corporate Director. Regeneration & Economic Growth) was held at that time and it was discussed that there would be no linkage with the Newcold development. I can also confirm that no objections to the planning application were subsequently received from the Trust or its members."

Yes, but it also states a bit you failed to include, for whatever reason.
" I can confirm that there was no Section 106 Agreement to link this development with the funding of a community stadium as the size of development (22,300sqm) is below the 60,000sqm threshold for contributing toward the stadium that was set out in the original outline application issued by the Secretary of State. "
I was under the impression that the 60,000sqm was the trigger point, I didn't realise that only units above 60,000sqm counted towards the stadium .

Because it doesn't, if YCP built a 1m X 1m box and leased it out then it would count towards the 60,000m2 trigger.
The Council officers reply is misleading either because they're too incompetant to understand the S106 or they're intentionally lying.
There is a ruling in the Secretary of States Public Inquiry report which specifically disallows the aggregation of the land in question.
The WMDC have incorrectly allowed the Newcold planning application to be passed directly contravening the Secretary of States order. Why they've done this is up for conjecture, either they're incompetant or they knowingly shafted the Community and the Stadium Trust.
It stinks and they're now wriggling and spinning trying to get themselves off the hook

If that is the case then produce some minutes or documentation to prove this. Do you honestly think if people had been aware of this they would not have kicked up a stink. Also how were the local public, you know the residents and Wakefield inhabitants informed of this decision to exclude from the S106? Do they not matter too?

| If any of the RL family fancy helping out in getting the community stadium delivered, please go to our Facebook page - fightfornewmarket and like.
For the twiteratti out there please look for #fightfornewmarket and throw a few retweets and favourites around!
We are not asking the council for a stadium, just for them to enforce their own planning regulations on a developer who is trying to wriggle out of their responsibilities and agreements.
Thanks!
