If Bradford feel that the punishment is unjust or incorrectly applied (and they have every right to feel that way), then they are within their rights to challenge that through whatever legal processes are availabe to do that.
Plenty of people argued that Leeds should have never taken to Bradford to court over the Iesytn Harris saga "because they already had Danny McGuire" and because "the RFL found nothing wrong with the contract". Of course, it later transpired that Leeds were absolutely right to pursue the action that they did.

| Have the RFL or the panel that considered the first appeal gone outside their remit or applied a penalty that is not in the rules?
If not I'm struggling to see how the High Court could overturn the decision effectively adjudicating on a private clubs' membership rules. If the penalty could be seen as unreasonable, maybe, but if its within the rules laid down by the RFL that member clubs effectively sign up to (say 2-8 points deduction for going into admin), how could it be considered unreasonable?
If they're arguing that the proper process wasn't followed and that it could start the whole thing off again, then Bradford are dafter than I thought.
"Sorry we didn't follow the proper process, here's your points back. Now we have followed it, we're taking them off you again."

| People seem to be labouring under the misapprehension that the High Court can overturn the sporting sanction of deducting 6 points. They can not do that, they have no jurisdiction to do that - they are only able to rule on points of law.
As I understand it, this action is to try and win the right to have the appeal against the points deduction heard. The independent panel didn't even consider the Bulls' appeal as they found that it had no merit and didn't meet the threshold of evidence and failed to offer any substantive grounds for an appeal. It wasn't so much that they rejected the appeal, more that they refused to even consider it in the first place. This is what Green wants, the right to have the appeal heard and considered.
Any court action is not an appeal against the points deduction in itself, it is an attempt to force the panel to consider the appeal against the points deduction.

| Since i stopped trying to keep up with the circus that is the Bradford Bulls can someone explain in simple terms what is it exactly they are taking to the High Court ? as far as i know they were deducted 6 points for going into admin (again) appealed it, lost the appeal and are now appealing against the appeal ?? if that's correct why ha ve they been hard done to ?

They didn't lose the appeal as such. It never got as far as even being heard as the independent panel ruled that there were insufficient grounds for appeal, so it was dismissed without a proper hearing even taking place.

Relegation is likely to be the end of the club so nothing to lose really.

| One major point, if the proposed changes to the league 2 x 12 and 3 x 8 is put on hold, scuppered or scrapped because of this what happens next.. Licensing currently ends as of 2014, what is to stop the RFL just having a mini licence period of 1 year and all league clubs have to apply, best 12 get SL1 licence next 12 get SL2 licence and rest get championship 1 licence. The RFL will determine the strength of clubs based on current and past licence records..
What Licence will they give the Bulls...????

IIRC none of the clubs who have been relegated have gone out of business and several have gone back up again fitter and stronger.
