Are people forgetting Lee Smith's signing to fans last year? Are they forgetting Ryan Bailey's spitting at opposition fans earlier this season? Neither of those things were punished with bans, either.

Normally I would say yes, ban him, but since it would be unfair (especially with the spitting), I suggest the RFL implement McLaren_Field's Leeds fan board's policy... ban all the Leeds fans instead.
