| Very hard to take any kind of legal action against someone who isn’t in the country and is employed outside of the UK.
The best Wigan can hope for is that the NRL don’t allow him to register for a club whilst Wigan hold his SL registration, so whoever signs him has to pay a fee.

It’s come from the horses mouth that his contract clause is at the end of the first season, you seriously think wigan would spend months negotiating and pay him 250,000 a y year just to let him walk before he’s put on the shirt? If he leaves before he’s played whoever wants him will have to pay a big fee as he’s UNDER CONTRACT. It’s not that hard to understand you stick to the small clubs where you could only dream of signing a top class player

Strong rumours that he's being courted by Bankstown as a stop gap for Foran, who's shoulder is blown and will miss all of 2020. Ian Lenegan as said JH is due to join the club in Late December, but he's "at home" at the moment and not tweeting, which is strange, because he's normally all over social media!
BTW. I find it odd that a poster who hasn't been on here for 54 months can give credibility to anything

Unfortunately, the fee is often determined by the context.
First and foremost, the length of time still remaining on a player’s contract. In this case, it’s only one year given his NRL release clause.
Secondly, whilst it’s frustrating, the player’s wishes impact massively on the fee. If Hastings has told Wigan he’s not leaving Australia, there’s not a great deal they can do but take whatever they are offered for him. In reality, they cannot compel him to get on a plane, come back to the UK and play for Wigan against his wishes.
Nor would they want to, as I can’t imagine they want someone who doesn’t want to be there.
I also doubt Wigan will go down the legal route. Taking legal action for BoC against someone who isn’t even in the country is complex and likely to fail. Even if he was in the UK, the club would have to prove they have suffered financial loss as a result of his BoC. That’s very difficult in this case as there is actually a financial gain for Wigan because they won’t be paying his salary!
As before, the card Wigan have is his registration. They need to hope the NRL don’t allow a club to register him without agreeing a fee for this. But let’s be realistic, Hastings and any club who want to register him have almost all the cards stacked in the favour.

Does it really, bet you can’t prove it can you? Immediately making it gash.
Bradford spent years perusing that particular avenue against Leeds, remind us all how that turned out.
Let’s get one thing straight, contracts are part of a remuneration package and as such fall under employment laws. Wigan and the RFL can huff and puff all they want but they can’t make a person work for a company they don’t want to work for, end of. It’s a bit more complicated that that, though.
You’re right, Wigan can’t make Hastings work for them through force. Slavery was ended years ago. They also can’t prevent him from working elsewhere. The NRL can refuse to let another club register him whilst Wigan hold his registration, but Wigan themselves have absolutely no legal basis for preventing him working for another company.
Why they can do sue him for BoC. They’d need to prove that they suffered a financial loss as a result of his BoC though. It’s never an easy thing to quantify, as of course they actually gain financially through not having to pay his wages. It’s completely impossible to quantify a financial loss based on supposition and prediction. They can’t turn around and claim that losing him will cost them a Grand Final appearance or a certain proportion of season tickets. All this is also made more complicated when the said ex-employee is no longer in the UK.

Or maybe he'll just turn up for training with Wigan, and that will be the answer !

You mean like Alan Shearer did at Newcastle United or Matt Le Tissier did at Southampton? Playing for a club they loved and potentially dismissing any opportunity to win trophies at "bigger" clubs in order to be happy?
Imagine that eh? Someone playing for the love of a shirt and not just a fancy villa, a nice bottle of vin rouge and a top up to their pension fund.
PS. If Hastings didn't pull on the Wigan shirt would this be a record for the "Wigan Walk" to be performed before a match, rather than the customary 50-60 minute mark?

| Aussie player in "homesick shocker", not the first and wont be the last.
Fundamentally however, it is wrong that any player can sign a contract and then just walk away (unless there is a major injury problem).
Bit of a problem for Wigan though, maybe they will sign Matty Smith from Catalan ?

Hastings sounded out by the Doggies. His agent goes through his new contract with Wigan with a fine tooth comb - finds a breach in the agreement regarding the press release where Hastings didn't want the release to be made until after his duties with Salford were complete. Something so small could derail the contract.
