Well apart from what your saying isn't strictly true I would say that Wigan fans (Myself included) are likening it to Driving penalty as that is similar to what other posters have used as examples to have a go at Wigan for previous offences just like a driving penalty so that's why we've used it back.
i.e. they've said
If it's a first offence "X"
2nd offence "X" times 2
3rd offence "X" times 3
Now I don't necessarily have an issue with that
I also don't have an issue and think it's incredulous that there aren't hard and fast rules relating the % a team is over the cap - But it appears there aren't?
My personal view however is that you can't multiply the offence for a year based on something that may have happened Many Years ago (Hence my 50 years ago comment) - I personally would have a scale of multiplication
i.e. Repeat offence in 3 years "X" times 4
Repeat offence in 5 years "X" times 3
Repeat offence in 10 years "X" times 2
10 years over say slate clean?
But I would also have a sliding scale of punishment and whatever the figures are I know would be debatable but surely 0.8% isn't worthy of a Penalty deduction
Fine a club for up to a 1% or 2% Misdemeanour (leave that up to whoever to agree but 2% would currently be up to around 40k) - But make that fine Double/Treble what the discretion is to disincentive the overspending.
Repeat offence as per above Go to the same fine plus a Points deduction increasing with every indiscretion in the 10 year period.
Seen suggestions about points deductions based on how much £Cash over the cap and no issue with what was suggested but the OP of that suggestion just conveniently puts it at 10k and under as a fine which is less than 1/2 % indiscretion - Conveniently slightly under the 14k cock up Wigan made - Leaving them in the 2pt bracket
if the cap alters etc. then fining on £ basis would need to constantly change that figure - Just make it a %
And whether that is 0.4% or 1% I don't particularly care as there is no current rule but 2pts for 1/2 % seems a bit much to me.
Saints went over the cap but not sure by how much 2002/3 ???

Now if a similar thing happened and they went over by 10/15k I wouldn't be pointing out that something 16/17 years ago should have such a big influence on what happened today
if 10/15k is a fine today - Then it's a fine
if it's 2 points then it's 2 points - But surely don't double or treble it because a team may have had 2 other breaches that could be 20/30/40 years ago

Didn't Wakefield appeal there 4pt penalty 17/18 years ago and got it reduced to 2points which enabled them to avoid relegation on points difference?
Why did they appeal if a deduction then meant 4pts - Why not just take 4 points?
If Wakefield transgressed in the future No good saying it was under a different regime - That argument apparently shouldn't work for Wigan so why anybody else?

I still find it amazing that from sets of fans that spend so much time telling everyone we should get more recognition from national media, want the game to grow, want the game to expand and be seen in a positive light
We then spend so much time limiting how much we can grow, criticise and hold back clubs that do try to grow and expand (Leeds/Saints/Wolfs amongst a few others) cry foul for the tiniest indiscretions and portray it as though WWIII has just started and continually run other clubs and the game down.
I believe the term used earlier was "Myopic Wigan Fans".
I would debate that isn't the correct term as I believe that means short sighted, uncreative etc. however my concern would be how many of the games Fans are "Myopic" when it comes to the game
We should be encouraging the Simon Moran's of this world to invest in our game, we should be encouraging them to Push the boundaries, take risks etc. and I understand some kind of protection against themselves may be needed but currently all I see is 99% of the fans of All teams crying foul on various fronts and running the game, it's players and it's clubs down.
As a Wigan fan I have to read how 90% of the Wigan team is rubbish - By it's own fans!

I see other fans of other clubs doing the same to their players, and I know it's a forum, but some of the stuff is incredulous in it's dismissive nature of rubbishing players and the game
I see fans of opposing clubs petty points scoring with each other over the tiniest things rather than Promote the game.
It makes me despair at times - Thank god I don't do Facebook or Twitter as I believe it's far worse
Looking forward to a Great game tonight Wire/Cas - I bet 90% of social media or posts on forums after the game will be negative and critical.
The game and it's fans will get what it deserves with it's attitude to itself.
