I would agree with that were it an administrative error in this case. It wasn’t, however much Lenagan might try and say it was. The rules are simple, easily available and when it was pointed out to them they disputed it should count on the cap. That’s not an administrative error. That’s trying to get away with going over the cap. Which they’ve now done thanks to Lenagan’s new bestie.

| Salary Cap Stuff like this should be "cast in stone" to stop appeals, something on the lines of with no excuses accepted:
1 to 10,000 .................caution.
10,000 to 20,000.........2 points
21,000 to 50,000 .......4 points
51,000 + ..................6 points and fine equivalent.

That's my reading of it too - their first response was to defend their actions and claim that it's a stupid rule anyway; which indicates that this wasn't some Excel slip-up by the Accounts Apprentice, but a deliberate act.
It does rather make a mockery of the rules, which will bite them when the next breach happens: "It was an admin error and we don't agree with the rule anyway, give us our points back," will now be the standard defence.

Excellent plan
Make an administrative error 2 years in advance that will cost you 2 points 2 years down the line that you know Will get back on appeal to appease the fans just in case you lose 2 games in succession 2 years in the future.

What about repeat offences? Isn't this the 3rd time Wigan have broken the cap?
It wouldn't prevent appeals either as UK justice procedures are essentially followed for any disciplinary investigation/ruling and that allows appeals.

Should previous offences be included if the club isn't run by the same people? I would guess the only people at Wigan now who were there when the cap was previously broken are O'Loughlin, Farrell and the kit man. I would assume that none of them are involved in club finances.

Yes, the Club is the entity being punished and the personnel will (should) be aware of previous transgressions anyway.

No rules to Wipe the slate clean etc. like you would do with Penalty points for a driving conviction etc.?
