| Wow. As a Hudds fan of long standing who remembers exactly how Bulls fans treated our club when we were in a similar financial situation I honestly didnt realise you werethat full of bitterness and hatred - how wrong can you be.
I also remember a short few weeks ago how the club was "called" by fans who had their facts wrong regarding tickets and money for tickets and a boycott called for- and were made to eat their words - by the very man being vilified on here today. That man generously gave to your club (dont remember you helping us out in our hour of need) just a few weeks ago.
Yet again the knives are out against us - again without facts being known.
What a good job the bitterness directed towards our club from Bulls fans isnt reciprocated from the fans and the board at the Giants. Im beginning to wish it was.
Please you bitter twisted people dont come to Huddersfield-your kind arent welcome.

| Quote: Stul "If Kopczak claims that his contract became void on 31 August, but played on 1 September, would that not infer an acceptance of the TUPE to the new company. He surely shouldn't have played if not contracted.'"
You've hit the nail on the head there!

Wow, you must not post on Huddersfield board that often if that's your opinion of it.

| Employment issues in insolvency is something I regularly advise on as an employment solicitor.
TUPE transfers occur by operation of law, it's not something a buyer can decide. In admins it usually occurs when the new co starts trading. Any employee employed just before transfer who hasn't objected to transfer in writing automatically transfers to the new company on the same terms as before. The new co stand in the old co's shoes.
It would be interesting to know when/if the new co took over running the business of the bulls.

I don't know, but I'm not sure it does. Didn't we hold Karl Pryce's registration when he left us for Union?
Also, wasn't the whole thing with Harris over Bradford getting him to break a contract? And we lost that case. So precedent set there, I think.
Given all clubs agreed to not approach any contracted Bradford player, surely this does mean that the club approached a player under contract?

That was the one I was thinking of. Pryce's registration was held until the end of his contracted period so when he went to Wigan there was a fee agreed to transfer his registration.
Inducement to breech contract is difficult in this case because if Kopczak has legally terminated it there is no breech so how can there be inducement to breech.
Of course all the fine moral folk who keep telling us Ok Bulls have a moral duty to pay the debts of the old company will obviously be equally annoyed if anybody has approached Kopczak while under contract even if the termination is perfectly legal, as was the sale of the Bulls to the new company...

Interesting. What happens if the administrator hadn't discussed TUPE options before transfer or given the employees the option and/or time to reject it?

| Have I missed something somewhere, why are Bradford in this position? Is it Huddersfields fault? Nope that's right it's their own making but they go off crying to the RFL to bail em out.
You played the gambling game, you lost!!! Get over it and to be fair your licence should be revoked and Halifax or Fev replace you.
Professional players play as a living and can see why players would want to be guaranteed to get paid when they have a mortgage and bills to cover!!

The players have been paid so the clubs side of the contract has been upheld. Is it unreasonable to expect players to stick to the contracts they signed or to expect other clubs not to approach players under contract to another club?

There has been a few individual posters making derogatory comments regarding Huddersfield on this site and you seem to unreasonably assume that these few represent the whole consensus of all of us 10,200 season ticket holder fans.
We do not presume to speak for the other 10,188 . We enjoy the crack at Galpharm, great stadium, and invariably a competitive game.

I do not know the answer but i thought that the players were being paid by the RFL rather than the club. Would that not in a sense amount to a breach of contract by the club as in reality they were saying we cannot pay you but somebody else will cover it so you do not lose money ?

| I would guess that all that is happening is that there is a game of brinkmanship going on.
The amount of money potentially to be paid by any club who signed Kopczak would be fairly miniscule compared to the legal fees involved.
I bet 10 to a dozen ther is a lot of bluster and name calling. The rfl will say we are looking into it, then Bradford and A N Other team will say we have agreed a settlement re Kopczak.
Bradford fans will say on here we Got £500,000 for him and Giants fans will post on our site we paid £50. (If indeed he comes to the Giants)

| .... But there is no evidence that Huddersfield - or any other club have contacted kopczak. For all we know thd journo at T and A may have heard the rumour on these very boards! There is no evidence that the bulls hadn't already made an agreement to accept a transfer for kopczak. All there is is one journalists conjecture. But don't let that stop you anyone.
The poor guy may have just had enough of being worried, with his family afraid to spend money in case in a few weeks time he doesn't have a wage- I've been there personally and it puts a massive strain on the whole family. Perhaps he just wanted to feel in control of his future.

| But you must admit it's very unlikely Kopczak has decided on a whim to terminate his contract with no other offer available. However if we see him leave rugby and start working in some other profession I'll accept he just fancied a change of career.
