| I see some of the Wigan fans uptight that we are taking the moral high ground on Zak.
There`s also mention of McGuire pretending to be injured that cost them in the semi final what 5 years ago now was it, moving the goal posts when Wigan were taking a kick at goal and booing Tomkins when he played for England.
And we signed Hanley who was a bad un.
Pretty much got most of that wrong then.
Of course Wigan always abide by the rules and wouldn`t do anything to cheat a game or the system and would never dream of signing bad boys.

The money will be extracted from Hardaker.
As he committed the first repudiatory breach of contract (be getting faced on alcohol and class A), the club were well within their rights to dismiss him. However, Because he committed the repudiatory breach, he is liable for any financial loss caused by this. In this case, the £150k that it cost to buy him and indeed the cost of his replacement.
The precedent here is the Adrian Mutu case. He failed a drugs tests (cocaine) and was sacked by Chelsea, who then recovered the cost of his transfer fee (£13m) and also the cost of replacing him (£22m). Mutu appealed to every court possible but failed every time. His breach of contract left him personally liable for all Chelsea’s financial loss, including “the wasted costs of acquiring the Player and the cost of replacing the Player” (quoted directly from the court judgement).

In fairness, his employment is pretty irrelevant. If Cas bring a case and win, he becomes liable for the cost regardless of income, whether this be earnings from a new contract or recovery of assests etc (or indeed a combination of both).

If you're citing the Mutu case as a precedent then it's worth noting that Mutu was only held liable for around 40% of the £35m figure you've stated. In any case, I suspect that were Cas to pursue this, all that'll happen is that ZH will declare himself bankrupt and they'll be left with a legal bill to foot.

| Guys, can I please ask that the Gary Lo sacking / dismissal / release "rumours" aren't spread on here.
I'm not being a killjoy, I think that most people are aware of the rumours circulating at the moment and TBF if they are true then its a shocker, however until such time as there is an official presser stating such "facts" then please DO NOT POST THEM!
Such posts are against the AUP we all signed up to when we joined these forums.

I remember it being reduced, but I thought they only reduced the amount he had to pay back in terms of his own transfer fee. This was because although they paid £22m, he had actually played for the club and therefore Chelsea had some “value” from his fee, so couldn’t claim it had all been wasted.
In terms of Hardaker it’s different. Cas had him on loan until the end of the season anyway. Consequently, we saw no value from the £150k whatsoever.
If anything, Cas’ biggest mistake was paying the fee earlier than necessary. Knowing his history, common sense would have disctated leaving it as long as possible before paying the fee.
