Being charged with a crime dosent make you a criminal. Well not in the UK anyway IIRC.  |

then and only then IMHO are you deemed to be a criminal.

I wasn't on about being a criminal. I was on about whether it was a criminal act.
You are right though that you can do a criminal act without being a criminal.
