Look at the picture. His middle finger is quite clearly extended into the eye of Hill. That is undeniable.

Hardaker must have this planned for a while, not only did he think to have his hand in a position which wouldnt naturally be thought of as one to use for gouging, he also did it from behind and whilst looking away to disguise it.

Granted the picture doesn't look great.

But do what I then did and watch the video which will always be a better indicator than a still photo. He catches the eye but not a deliberate attempt IMO. Realistically you could get dozens of pictures post games of dodgy looking things happening in the tackle.

What minute of the game did it happen?

For mine, the picture looks bad, but it is a fraction of a second frozen. The video, to me tells a totally different story. Contact looks to be made, but only for an instant. No case to answer.
