Do we have any employment lawyers or HR specialists on here who would like to comment on the legal/employment aspects of this matter.
What Bailey's done is no doubt in bad taste but afaik he's committed no other offence & it's not in direct pursuit of his employer's business.
Had this been Frankie Boyle on Mock the Week we may have winced but would anything more occur?
I've received many texts on the lines, I guess, of what Bailey posted & I bet I'm not alone on this board in that respect.
The difference is I've kept them to myself & not posted them on to a social website.
I'm also certain Bailey is not the only one to contribute similar material to facebook or twitter.
He should apologise, promise not to be so naive/stupid/insensitive in future.

His employer could take action against him; he could be deemed by his actions to have brought them into disrepute and as such, face disciplinary action. That would more than likely result in some form of written warning.

If I were his employer, I would (and indeed have) do that, for several reasons. Primarily, to protect my public image, but also to send a message to the perpertator and his colleagues that social networking nitwittery that impacts negatively on the company image won't be tolerated. And because I hate Facebook.

Exactly, Bailey is an employee and represents them at all times.
The last things Leeds want to do is appear to be mocking the events in Japan.
People on here say 'well we've all done it' - but you arent all in the public eye and have the reputation of your employers to consider.

And bottom line - mocking the awful events in Japan can neither be condoned or pushed aside. To do it shows just how much a pr*ck you are, and those who laugh it off or try and justify such behaviour are bigger pr*cks!

I study law at uni, not done employment law yet but done a bit on human rights and freedom of expression etc. From what I can gather it was bad taste but nothing more than that and so he hasn't done anything wrong in the eyes of the law. It is also not anything directly to do with his job unless he has clauses in his contract about his image rights/representing the image of the club which is probably the most likely reason they have got involved.

Yeah - login into Facebook, mock other peoples misfortune, then sit back and look at your 4 Super league medals and justify your pr*ckish behaviour because they justify any type of behaviour!
