think he might get away with it as Burns is on the floor before his head. I.e hardaker tackles him burns goes to the side his arm/shoulder are down, Then his head and the rest go down. Not a deliberate tip, not executed dangerously, not driven in to the ground. If he gets a ban I wouldn't really argue against a game or so
