| We still dont know who Cas are taking to court, is it Solomona, his agent or Sale my guess is Cas would only get a big payoff if they take Sale to court and win.
It was 7 November when I did some digging and read inside sources at Sale saying Solomona's signing was imminent, but I've heard nothing since.
Have they tried to distanced themselves from Solomona,or did Sale contact Cas saying they are now going to sign him as hes retired from league but were willing to compansate Cas a measly sum?
This top QC must think Cas can win but against who?
I think Cas are going after everyone.

I would imagine it would be mostly against Sale. It's pretty similar to the Harris case and you would imagine would end up with the same result.
Sale really dropped one with taking photos of him at their place. Its hard to see how they could be found anything other than guilty of inducing or assisting Solomona in breaking his contract.
If they've any sense they'll offer Cas a transfer fee equivalent to the highest Cas were offered elsewhere to avoid court.

| Sale sharks argument will be he retired from RL and chose to play another sport and there is no agreement between league and union to honour each others bans.
Remember all those union converts from when union was amateur all were given bans by the RFU and we ignored them so apart from banning from league can't see anything other than Cas accepting an undisclosed fee.

Yes but sale officials were seen at Denny's house before this so called retirement from rugby league. Then their is the case of Denny turning up to sale training session while still a Castleford player.
Cas have a strong case here.
The repercussions for the sport if sale and Denny win is plain bad news. What's to stop other player pulling the same retirement trick when they get offered huge wages from a union side as there would be no transfer fee involved.

They will claim and he and his agent will confirm he had already made his decision but forgot to notify his club. As for turning up at Sale and training didn't stop all those A N Other appearing in league sides.
Personally think it's going to be difficult to stop it after all we don't seem to be able to stop it happening between our own clubs

You would hope that there were provision for this within the standard playing agreement.

Just think it'll end with the undisclosed fee statement.
It's going to be difficult for a court to say you cannot play any other sport other than league a ban from league yes a ban from other sports unlikely.
I'm sure some legal brief will quote Chase retired from the sport and was allowed to sign for Cas (with Leighs agreement) and that Dwyane Chambers was serving a ban when he signed a trial contract at Cas

Chase did so with Leigh's permission so didn't breach contract, Chambers had no contract to breach.

| Theo Farges? Joel Moon? Hudson Smith? All walked out on a contract all against their clubs wishes all signed elsewhere for the UNDISCLOSED FEE.
Can't see this ending any other way

because their clubs allowed them to.
If they do come to some agreement, it probably will be undisclosed, but I wouldn't bet on it being an insignificant amount.

| The amount will be irrelevant for the new Sale owners already taking of spending millions.
Don't get me wrong nothing would please me more than Sale getting hammered in the courts but look at their history they stitched up Sale RFC when stealing their name they stitched up Stockport County when they bought Edgley Pk and they didn't do a bad job letting Salford nearly bankrupt themselves getting Barton up and running only to take the opportunity to get control of the stadium without spending a penny

In the end remember Marwan Koukash demanding a world record fee for Farges to deter Saints didn't work.
Like I've said that will be the outcome of this also a lot of talk a lot of posturing and in the end he signs for Sale.
Cas need to get the best deal they can but if they dig in to much Sale will let it run and if a court rules against them (unlikely) they will move on and Cas end up with a very unhappy player and we've all seen where that ends
