My understanding was that the issue was assaulting the test bloke. These blokes don't turn up at random in the middle of the night. The player says when he'll be in and he has to be in. It's usually in a morning so he has the rest of the day to himself but it's the player's choice.
Ironically, as you imply, he would probably have been banned for less had he just proved positive.
